General terms and conditions
For the manufacture and supply of 3D-printed parts and agreed CAD, design and data preparation services. Last updated: 22 September 2026.
1. Contracting party and scope
FORMACT is a business division of WebTec Braun GmbH, Max-Hickl-Str. 10, 83026 Rosenheim, represented by managing director Tobias Braun, registered in the commercial register of the Traunstein Local Court under HRB 21742. Contact: info@formact.de.
These terms apply to contracts between WebTec Braun GmbH, referred to below as FORMACT, and consumers or businesses where they have been duly incorporated into the contract. Individually negotiated agreements take precedence. Mandatory statutory rights remain unaffected.
2. Non-binding enquiries and contract formation
The website provides information about services, materials and examples. By uploading files or submitting a form, you request a review and an individual quotation. This does not yet create an order for which payment is due. Successful submission confirms receipt, not technical feasibility or acceptance of an order.
After review, you will receive a written quotation, for example as a PDF by email. It specifies the scope of services, applicable files, material, quantity, price, date and, where applicable, shipping and additional services. Any reviews or design work subject to a charge are quoted separately before they are performed.
A contract is formed when we receive your explicit, unmodified acceptance of the quotation within the applicable period, for example by email. The quotation sets out its validity period and the conditions for performance. Where advance payment is agreed, the relevant work begins after payment is received. Any changes to an acceptance are agreed before work is performed.
Further file submissions do not in themselves constitute an additional order for which payment is due. Technical file approval and acceptance of the quotation are coordinated in a documented manner. Any non-binding cost estimate does not replace the price in the accepted quotation.
3. Services and technical specification
The specific quotation and agreed specification determine the scope of services offered.
The agreed specification is based on the quotation and technical documentation. It may include dimensions, tolerances, material grade, colour, surface finish, post-processing and intended use. Process-related features such as layers or support marks do not permit arbitrary deviations from agreed properties or statutory quality requirements.
Special requirements relating to loads, temperature, contact with substances or regulated applications are agreed before the contract is concluded. Material names and illustrative examples do not imply blanket certifications or approvals.
4. Files, customer cooperation and changes
You provide the data and information required for the order and identify the applicable data version. Unclear information is clarified before the affected work is performed. Please submit only content that you are permitted to use for the requested purpose. FORMACT is granted the use required to review the enquiry and perform the contract; this does not transfer all rights.
A printing-only service does not automatically include complete new development or a comprehensive assessment of every conceivable use. FORMACT's own statutory and contractual duties to examine and provide information remain in place.
The price and timing implications of changes to data, materials, quantities or scope are agreed before work is performed. Additional costs do not arise without the corresponding work being commissioned. If missing information or approvals affect the process, FORMACT will inform you of the specific consequences.
5. Prices and payment
There is no minimum order value. The accepted quotation is binding. Consumers receive total prices including applicable VAT. Shipping costs and calculable additional costs are disclosed before the contract is concluded. Quotations for businesses clearly indicate whether prices are net of VAT.
Print orders for business customers based in Germany with delivery in Germany are invoiced with payment due 14 days after delivery. The invoice is provided no later than delivery. If the invoice is received later, the payment period begins upon its receipt.
Orders for private customers, all international business, and new CAD creation and design are carried out against advance payment. International business is paid 100 per cent in advance. For mixed services, CAD modification only or agreed development phases, the quotation describes the amount, due date and payment terms for each part of the service.
Express, overnight and other special services, together with their individual additional costs, are agreed before they are commissioned. Statutory rights in the event of non-performance or defective performance, including applicable rights to withhold payment, remain in place. The statutory requirements apply to late payment.
6. Deadlines, shipping and collection
Production and delivery dates are agreed for each project. They take account of material, geometry, quantity, preparatory work, approvals, payment receipt where applicable, and shipping time. The quotation specifies when the relevant period begins. Agreed dates and statutory rights in the event of delay remain binding.
FORMACT generally delivers worldwide by agreement. The quotation states the delivery location, available shipping method and shipping costs. Collection locations and times are agreed personally. For deliveries outside the EU, additional import costs, customs clearance and responsibilities are explained before the contract is concluded, insofar as they are relevant to the quotation.
Express and overnight services are available following review and subject to agreed additional costs. For suitable small parts, production with courier delivery within 24 hours may be agreed. Such a service applies only under the expressly confirmed conditions; there is no general 24-hour guarantee.
For consumer purchases, shipping risk generally passes upon delivery to you or a recipient designated by you. Statutory exceptions remain unaffected, in particular where you independently appoint a carrier not previously named by FORMACT. For business transactions, the statutory rules apply.
7. CAD deliverables and rights of use
The CAD quotation describes the work to be delivered and the file formats. Editable source files, neutral exchange files, drawings and print-ready models are different deliverables and are agreed accordingly.
The rights of use required for the intended purpose are specified in the quotation, in particular modification, in-house manufacture, manufacture by third parties and exclusivity where applicable. The customer's pre-existing rights remain in place. Where partners provide services, FORMACT ensures that the agreed rights are granted to the agreed extent.
8. Confidentiality and limited file storage
Non-public customer files and technical project information are treated confidentially. Access is limited to people who need it for the enquiry or contract performance. Partners involved receive the necessary information under appropriate confidentiality requirements. Your files or parts are published as references only with separate permission.
File submission serves the enquiry and, where applicable, the agreed order. It does not commission a permanent archive or recovery service. Please keep secure copies of your original files and the deliverables provided. A new upload may be needed for repeat production.
Files and personal data are stored for limited periods and specific purposes. The actual criteria and retention periods are described in the privacy policy. Business records subject to statutory retention requirements are distinct from CAD file storage. Contractual duties of care and performance remain unaffected.
9. Defect claims and liability
Statutory rights relating to defects and liability apply. Neither custom manufacture nor the possible absence of a right of withdrawal removes these rights.
The legal classification depends on the agreed service. Manufactured parts, design services and digital deliverables are not all treated identically. You may send complaints to info@formact.de. Descriptions or images help us handle them; statutory claims do not depend on a particular form.
10. Withdrawal and order changes
Before the contract is concluded, consumers receive withdrawal information appropriate to the specific scope of services. A statutory exception may apply to individually manufactured physical goods. This exception is not applied indiscriminately to CAD services or digital files.
An early start to services and any possible loss of the right of withdrawal are explained and confirmed separately where required. Uploading files does not constitute such consent. Requests to change or end an order are handled individually. Statutory rights of termination, rescission and withdrawal remain in place.
11. Statutory framework
The relevant statutory provisions apply. These terms do not impose an exclusive place of jurisdiction to the detriment of consumers or a choice of law that displaces mandatory consumer protection. The specific quotation, including supplementary consumer information, is provided before binding acceptance.
